The Transportation Services Internal Investigations Unit (IIU) holds centralized responsibility for the consistent and timely divisional investigations, working with impacted and interested parties both internal and external to the City of Toronto.

 

Reporting to the Director, Business Performance, the Manager, Internal Investigations leads and manages investigations into a diverse range of issues, ensuring investigations are conducted in accordance with workplace investigation jurisprudence, best practices, and applicable legislation. This includes conducting workplace investigations, investigative follow-ups, case preparation, testifying in court or arbitration, and coaching/advising colleagues on investigation processes.

 

The Manager will provide strategic leadership, guidance, and subject matter expertise to staff throughout the investigation process, including the development of investigation plans and reports. This position offers a unique opportunity for a strategic and analytical professional to lead complex investigations in a dynamic municipal environment, driving accountability and excellence across the Transportation Services Division.

In this role, you will be working in hybrid work model, following City of Toronto's Workplace Modernization Program, supported by the City’s Remote Work Policy. You must be able to travel to various locations in the City to perform duties of the role.

Major Responsibilities

As Manager, Internal Investigations, your responsibilities will include but not limited to:

 

Investigation Oversight & Execution

  • Leads and conducts thorough and objective investigations regarding allegations of misconduct or wrongdoing for unionized and non-unionized staff across the Division.
  • Reviews and analyzes files with a focus on fact-finding, procedural fairness, timeliness, and attention to detail and ensures investigations are in compliance with all legislation, including the Human Rights Code and the Memorandum of Understanding ( MOU.) associated with the Traffic Agent Program.
  • Applies trauma-informed approaches and de-escalation techniques throughout investigations when conducting workplace investigations involving parties who have or are experiencing trauma, or varying degrees of mental wellness, those who are emotionally distressed or have dysregulated behavioural outbursts.
  • Utilizes a variety of communication and psychological safety training, including different strategies to effectively communicate with persons of diverse abilities and backgrounds who may be distressed, confrontational or emotional due to an alleged incident. Coaches IIU staff on applying same.
  • Conducts on-site interviews and meetings; gathers evidence at various work locations. Records and maintains meeting minutes, electronic and hardcopy records.
  • Oversees the assessment of evidence and credibility analysis of the parties to make factual findings and provides detailed reports, confidential communications, and briefings.
  • Provides guidance to the Unit on determining whether the factual findings amount to a breach of the applicable City bylaws, policies, procedures, or legislation.
  • Ensures that all complaints and investigations received in the IIU are resolved in accordance with established divisional complaint procedures.

 

Governance & Compliance

  • Ensures the effective administration of collective agreements and seeks advice from Corporate Employee Relations when providing guidance on collective agreement matters and employee related issues. May be required to participate in dispute resolution, the grievance procedure and arbitration.
  • Testifies and gives evidence regarding investigations in legal procedures, including mediation, arbitration, Ontario Labour Relations Board, Ontario Human Rights Tribunal hearings, criminal and/or civil litigations.

 

Data Analysis & Reporting

  • Leads the analysis of investigation-related data and performance metrics to identify trends, gaps, and opportunities for improvement.
  • Oversees the development and maintenance of dashboards and reporting tools to monitor unit activity and outcomes.
  • Oversees the preparation of comprehensive analyses, reports and presentations for senior leadership, providing evidence-based insights to support and provide recommendations on strategic decision-making and ensure accountability across the Division.

 

Equity, Leadership & Culture

  • Develops and implements detailed plans and recommends policies regarding program specific requirements.
  • Manages, motivates and trains the unit's staff, ensuring effective teamwork, high standards of work quality and organizational performance, continuous learning and encourages innovation in others.
  • Provides leadership, subject matter expertise, coaching and guidance to IIU staff through the investigations process, ensuring effective teamwork and communication, high-quality standards and organizational performance.
  • Maintains an up-to-date knowledge of workplace investigation principles, theories, practices and tools, research, and interviewing techniques through ongoing research and professional development, as well as all forms of discrimination and harassment. Applies an equity lens concerning anti-Indigenous and anti-Black racism within workplace investigation practices.
  • Represents the IIU on task forces, corporate initiatives, and other committees. Develops and delivers education and/or training on investigation policies, procedures and best practices.
  • Upholds, models and contributes to an environment which supports and values equity, inclusion, and organizational change.
  • Ensures the IIU maintains neutrality when reviewing information and that investigation staff have a thorough understanding of the impacts of systemic racism and barriers related to workplace investigations to ensure equality under protected Ontario Human Rights grounds is adhered to.

 

Key Qualifications:

  1. Post-secondary education in a related area (e.g. labour relations, law, workplace investigations) or an equivalent combination of education and experience. Investigative certification (e.g. ASIS, PCI, CFE) or Private Investigation certification/experience would be an asset.
  2. Extensive experience working in a major, multi-union public or private sector organization.
  3. Considerable experience conducting workplace investigations (e.g. incivility, harassment and discrimination, theft, nepotism, fraud).
  4. Advanced interviewing techniques and evidence assessment skills.
  5. Ability to exercise judgement and discretion and apply a broad perspective requiring an integrated knowledge of human resource management, related disciplines and business processes.
  6. Strong organizational skills with ability to maintain accurate, detailed documentation and records, both electronically and in hard copy.
  7. Strong analytical skills to conduct research and assess evidence to determine relevance, reliability and sufficiency.
  8. Excellent presentation and communication skills and ability to communicate effectively, both orally and in writing, with various levels of staff within the organization.
  9. Ability to exercise sound judgement, integrity, remain independent and impartial.
  10. Extensive understanding of collective agreements and case law related to conducting investigations in a unionized environment.
  11. Highly developed interpersonal skills with the ability to effectively develop and cultivate productive working relationships with staff at all levels of the organization, including legal counsel and union officials.
  12. Thorough knowledge of the City of Toronto and Toronto Public Service, related legislation such as Ontario Labour Relations Act, Human Rights Code, Employment Standards Act, Occupational Health and Safety Act.
